Terms of Service

TL;DR: Use Bookr responsibly. Don't abuse the platform, spam users, or do anything illegal. We'll provide the service as-is and do our best to keep it running smoothly. You own your data. Be respectful to others.
1. Acceptance of Terms
By accessing or using Bookr ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please don't use the Service.
These Terms apply to all users, including freelancers, clients, and visitors. By creating an account, you confirm that you're at least 18 years old and capable of entering into a binding agreement.
2. Description of Service
Bookr is a platform that helps freelancers and clients manage holds, bookings, invoices, and payments. We provide tools for:
- Creating and managing availability blocks
- Placing and accepting holds with transparent ranking
- Confirming bookings and managing schedules
- Creating, sending, and tracking invoices
- Syncing with external calendar services (optional)
- Facilitating communication between parties
What Bookr is NOT: We are not a payment processor (we facilitate invoicing, but payment happens between you and your clients). We are not an employment agency or contractor. We don't verify credentials or guarantee work quality.
3. Account Registration and Security
3.1 Creating an Account
To use most features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Take responsibility for all activity under your account
3.2 Account Termination
You may delete your account at any time from your settings. We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent, abusive, or illegal activity
- Your account is inactive for an extended period
- Required by law or government request
We'll provide notice before termination unless legally prohibited or in cases of severe violations.
4. User Conduct and Prohibited Activities
You agree NOT to:
- Violate any laws or regulations
- Infringe on intellectual property rights of others
- Upload viruses, malware, or malicious code
- Spam, harass, or abuse other users
- Impersonate others or misrepresent your identity
- Scrape, data mine, or use bots to access the Service
- Attempt to bypass security measures or access restricted areas
- Reverse engineer or decompile any part of the Service
- Use the Service for any fraudulent or unauthorized purpose
- Interfere with or disrupt the Service or servers
Violations may result in immediate account termination and potential legal action.
5. User Content and Intellectual Property
5.1 Your Content
You retain ownership of all content you upload (profiles, portfolio images, project descriptions, etc.). By using Bookr, you grant us a limited license to store, display, and process your content solely to provide the Service.
5.2 Content Responsibility
You're responsible for your content. You confirm that:
- You own or have rights to all content you upload
- Your content doesn't violate copyright, trademark, or other rights
- Your content isn't defamatory, obscene, or illegal
- You have permission to share client names and project details
5.3 Bookr's Intellectual Property
The Bookr platform, logo, design, code, and features are owned by us and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute our intellectual property without permission.
6. Holds, Bookings, and Payments
6.1 Holds and Bookings
Bookr facilitates holds and bookings between freelancers and clients. We are a platform, not a party to these agreements. You're responsible for:
- Honoring holds and bookings you accept
- Communicating clearly about availability and terms
- Resolving disputes directly with the other party
- Understanding that holds are time-sensitive and may expire
6.2 Invoices and Payments
Bookr provides invoicing tools, but we don't process payments directly (unless you use integrated payment providers like Stripe). You're responsible for:
- Ensuring invoices are accurate and comply with tax laws
- Collecting payments from your clients
- Paying freelancers for completed work (if you're a client)
- Reporting income and paying taxes as required by law
6.3 Transaction Fees
During the beta period, Bookr is free. In the future, we may charge a small transaction fee (currently planned at 0.5% split between parties) or offer premium subscriptions. We'll notify users before implementing fees.
7. Third-Party Services and Integrations
Bookr may integrate with third-party services (Google Calendar, Stripe, etc.). These services have their own terms and privacy policies. We're not responsible for:
- Availability or performance of third-party services
- Changes to third-party APIs or terms
- Data breaches or issues with third-party providers
- Disputes with third-party services
You use third-party integrations at your own risk. Review their terms before connecting.
8. Disclaimers and Limitations
8.1 "As-Is" Service
Bookr is provided "as-is" without warranties of any kind. We don't guarantee:
- Uninterrupted or error-free service
- That all bugs will be fixed immediately
- That the Service will meet your specific needs
- The accuracy or reliability of user-generated content
- That users will honor their commitments
8.2 Limitation of Liability
To the maximum extent permitted by law, Bookr and its founder are not liable for:
- Lost profits, revenue, or data
- Indirect, incidental, or consequential damages
- Disputes between users
- Failed bookings or unpaid invoices
- Data loss due to service outages
Our total liability is limited to the amount you've paid us in the past 12 months (currently $0 during the beta).
8.3 No Professional Advice
Bookr doesn't provide legal, financial, or tax advice. Consult professionals for advice on contracts, invoicing, or taxes.
9. Indemnification
You agree to indemnify and hold Bookr harmless from any claims, damages, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your content or conduct on the platform
- Your breach of contracts with other users
- Your violation of any laws or third-party rights
10. Dispute Resolution
10.1 User Disputes
Disputes between users (freelancers and clients) should be resolved directly. Bookr is not a mediator or arbiter. We may provide communication tools but are not responsible for resolving conflicts.
10.2 Disputes with Bookr
If you have a dispute with us, please contact alex@bookr.dev first. We'll try to resolve it informally.
If we can't resolve it, disputes will be governed by the laws of the state of New York, and you agree to the jurisdiction of courts in that location.
11. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we'll notify you via email or a prominent notice on the platform at least 30 days before they take effect.
Continued use after changes indicates acceptance. If you don't agree with new terms, you should stop using the Service and delete your account.
12. General Provisions
12.1 Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Bookr.
12.2 Severability
If any provision is found unenforceable, the rest of these Terms remain in effect.
12.3 No Waiver
Our failure to enforce a provision doesn't waive our right to enforce it later.
12.4 Assignment
You may not transfer your account or obligations. We may assign our rights to another entity (e.g., in case of acquisition).
12.5 Force Majeure
We're not liable for delays or failures due to circumstances beyond our control (natural disasters, internet outages, pandemics, etc.).
